 November 6, 2009. State files Motion for Rehearing and Certification of Conflict in DEP v West, et al. Yesterday, the State filed a Motion for Rehearing with the 3d District Court of Appeal. The State also asked the 3d DCA to "certify conflict" with a decision from another Florida appellate court. (We have not seen the motions yet.) Motions for Rehearing are rarely granted, and the 3d DCA has a long history of not certifying conflict. (A "certification of conflict" improves one's chances the Florida Supreme Court will review a decision.)

On October 8, 2008, when Judge Garcia signed the final judgments in this case, the State was on the hook for $8,659,197, that included $630,000 deposited with the trial court in 2004, pre-judgment interest, and attorneys' fees. As of yesterday, 393 days of post-judgment interest has increased that sum by $714,413, to $9,373,610. Presuming the DEP is dissatisfied with the 3d DCA's response to yesterday's motions, and seeks "discretionary review" by the Florida Supreme Court, we estimate the supreme court's denial of review will not occur until April 21, 2010 (based on the identical scenario in the Collins appeal earlier this year). If so, the State's outlays will total $9,677, 190 ($1,017,993 due only to the appeal).

[Sal--no balls] I personally have no beef with Sloan Bashinsky. I like Sloan. I like his antics and his off-the-wall postings. He provides a different voice. On the other hand, the issue is with Sal in Key Largo. Here's what Sal doesn't tell you.

He posted a comment on our website under an email address different from the one he uses here, and listed the name as Clyde Jones. (He was really up front with that one.)

Sal doesn't like me and I could care less. I'm liked by some, hated by some. I deal with them all. Sal took the coward's way. He posted an insult to my wife, who doesn't write anything for the paper and is in no way a public figure. I called him out for it, asking him to identify himself to me so we could talk face-to-face, mano-e-mano and air out any issues he might have. Of course, the coward's way is to go after the women, which he continued to do by sending insulting internet emails, changing his email address twice and still identifying himself as Clyde Jones. (Still up front?)

After about a half-dozen of these emails, I sent one to both fake email addresses which Sal conveniently pasted together on the Coconut Telegraph to make it look like I was attacking him for a simple web post. At least three times I asked him to come out from behind the fake name and reveal himself, and speak to me since it was obvious his beef was with me. Of course, a coward can't do that.

He even tried to get the Coconut Telegraph to post a fake party at my office, again using his fake name and different email.

I did what anyone seeking harassment relief must do under the law. I issued a cease and desist statement. That's the first step anyone must take.

Sal has ignored that and continues to post untruths that are demeaning about my wife, and he still hasn't had the guts to reveal himself to my emails.

Sal used to spend a lot of time talking about his balls. Now we see he has none.

I do not take libel of my wife lightly, nor do I take implied threats lightly in her case. Threaten me all you want. Take whatever pot shots at me you want. I am, under some interpretations, a public figure.

I hate to say this because I really like Ed, but if he lets anymore through from Sal on this subject, he'll have to receive the same email. I'm required to do that.

Has the Tide Turned?

Since 1986, the Florida Keys' confiscatory land use regulations have been imposed only on owners of undeveloped land. Two-thirds of those landowners reside outside the Florida Keys. They have no right to vote on the "got-miners" choices for the County Commission. Since the got-miners' "rate-of-growth" ordinance was imposed on the Keys in 1992, vacant landowners have been selling their property to the government at rock-bottom prices that rarely reached 15% of Fair Market Value.

In 1996, Andy Tobin and I sent Voice of Reason newsletters to just over 10,000 owners of undeveloped Keys' properties. Today there are only 4,000 such owners. The Keys' rate-of-growth ordinances have limited development to under 250 building permits/year since 1992 -- or less than 3,750 dwelling units in 17 years. This suggests about 2,250 parcels have been sold to government at unfair prices.

Now that the Florida DEP v. West, et al., decision has been released by the 3d District Court of Appeal, perhaps the remaining 4,000 owners of undeveloped Keys' land will realize that the State has been acquiring Keys' property -- for 17 years -- for about 10% of Fair Market Value. The 3d District Court of Appeal will issue its "mandate" on the West decision in two days (November 5th), and we assume the State is not dumb enough to lose another half-million dollars in interest on a high-risk petition for "discretionary review" by the Florida Supreme Court (only 11% are accepted for "review;" substantially fewer actually result in a reversal).

You know one guy that can dish it out and can’t take is Steve Estes of the News Barometer.  For years now he has ripped apart his fellow neighbors on No Name Key and has constantly berated them and other folks that are just minding there own business and just trying to live..  Well the other day I left a comment (I think that’s what a comment section is for) on his webpage about his old lady had better reduce her consumption of Taco Bell Tacos or she would change her present classification of a Beluga whale to a much larger Sperm whale. This is a copy of his unsolicited email to me….

An economics professor at a local college made a statement that he had never failed a single student before, but had recently failed an entire class.

That class had insisted that Obama's socialism would work and that no one would be poor and no one would be rich, a great equalizer.

The professor then said, "OK, we will have an experiment in this class on Obama's plan".

All grades would be averaged and everyone would receive the same grade so no one would fail and no one would receive an A.

After the first test, the grades were averaged and everyone got a B. The students who studied hard were upset and the students who studied little were happy.

As the second test rolled around, the students who studied little had studied even less and the ones who studied hard decided they wanted a free ride too so they studied little. The second test average was a D! No one was happy.

When the 3rd test rolled around, the average was an F.

The scores never increased as bickering, blame and name-calling all resulted in hard feelings and no one would study for the benefit of anyone else.

All failed, to their great surprise, and the professor told them that socialism would also ultimately fail because when the reward is great, the effort to succeed is great. But when government takes all the reward away, no one will try or want to succeed.

Could it not be any simpler?
